A 61-year-old Chinese language immigrant who was brutally attacked last April whereas accumulating cans on a New York Metropolis road has died from his accidents, authorities stated.

Yao Pan Ma had remained hospitalized and by no means regained consciousness following the assault in East Harlem, a household spokesperson stated. He died on Dec. 31, police stated Saturday.

Jarrod Powell, 49, was initially charged with tried homicide and two counts of assault as a hate crime within the assault, prices he pleaded not responsible to.

The case has now been designated a murder following Ma’s loss of life, police advised HuffPost on Monday, although upgraded prices had not but been filed.

Ma’s spouse has stated that he was accumulating cans to make ends meet after shedding his restaurant job due to the pandemic. That’s when surveillance video captured a person knocking him to the bottom from behind on the night time of April 23. Ma’s head was then repeatedly kicked and stomped on.

Powell’s legal professional didn’t instantly reply to HuffPost’s request for remark Monday.
